Permata55 Jakarta: President Joko Widodo, former Chief Justice of the Constitutional Court (MK) Anwar Usman, and the General Election Commission (KPU) were sued at the Central Jakarta District Court (Jakpus). The lawsuit was filed by the Indonesian Democracy Defense Team (TPDI) 2.0 because the three parties were considered to have committed illegal acts.
TPDI Advocate, Patra M Zen, explained that the legal action in question was passing Gibran Rakabuming Raka as a vice presidential candidate to accompany Prabowo Subianto. This is because Gibran’s registration still uses the old technical rules for registering presidential and vice presidential candidates.
“What is being sued is that at the time of registration, the KPU was still using KPU regulation number 19 of 2023 when it passed Gibran. Because we remember that the registration was carried out on October 25,” said Patra at the Jakarta District Court, Jakarta, Friday, November 10, 2023.
According to Patra, Gibran’s registration should have been accepted after the revision of the technical rules for registering presidential and vice presidential candidates was passed. The KPU should reject or return Gibran’s registration file which was submitted on October 25, 2023.
“So that is the KPU’s unlawful act of accepting the file on October 25, 2023 before the KPU regulations were updated or revised,” he concluded.
Patra came with three 1998 democracy activists to register a lawsuit. They are Peter Hariyanto, Firman Tendry Masengi, and Azwar Furgudyama.
They arrived at around 09.52 WIB. Registration was completed at around 10:32 WIB.
In their lawsuit, they hope that the defendant I, defendant II will be declared to have committed unlawful acts. Defendant II is Minister of State Secretary Pratikno.
Meanwhile, Firman Tendry Masengi said the same thing as Petrus. He considered the effort to pass Gibran as vice president as a form of treason against the constitution.
“There are efforts by the new regime to betray the constitution and build unlawful power,” Tendry said.
